Since 2023, Class Counsel, VCL, STMCL, and RCAV have been working toward a mediated resolution of the Liptrot et al class action with the help of Justice Archibald, a former judge of the Ontario Superior Court, while preparing for trial at the same time.
The parties recently appeared before Justice Coval, the judge in B.C. overseeing management of the class action in Vancouver, and informed him that the parties have made sufficient progress towards a settlement with VCL, STMCL, and RCAV such that the trial currently scheduled for October should be postponed to allow the parties to focus on finalizing the terms of the proposed settlement. Justice Coval granted this request.
Class Counsel, VCL, STMCL, and RCAV have 60 days until the next court date to finalize the details of the proposed settlement, which will then be made available to all of the class members through a formal notice program and submitted to the court for its review and approval. Any class member wanting to object to the settlement will have opportunity to do so. Class Counsel will also present a plan to address the remaining claims against the non-settling defendants.
STMCL is committed to finalizing the details of the proposed settlement and hopeful that pausing the litigation for this time will allow the respective parties to reach a comprehensive agreement that will earn the support of class members and the approval of the court.
